When Should You Register For VAT?

TaxIn theory VAT should be fairly straightforward, but in reality it frequently causes confusion over who needs to be registered and what can be claimed. Quite simply VAT is a tax that is charged by VAT-registered businesses on most goods and services. Generally speaking, when a VAT-registered business is charged VAT when it buys goods or services, it can reclaim the VAT. Basically, these businesses are acting like tax collectors - charging VAT, collecting the money and, minus VAT they've incurred, handing it over to HMRC.

 

Compulsory Registration

Businesses have to register for VAT when their taxable turnover for any 12-month period exceeds the VAT registration threshold, which is currently £77,000. However, if the business will only go over the threshold temprarily an exception can be requested from HMRC.

Also, if a business takes over another business that is already VAT registered then it will be required to register. This is based on the assumption that the joint income of the businesses will be over the threshold.

While these are the main reasons for compulsory registration, there are others. For example, if you think your business’ turnover will exceed the threshold within just 30 days or if you are trading outside of the UK.

NOTE: There are late registration penalties and/or failure to notify penalties along with surcharges and interest for late payment.

Are You A Subcontractor Or Employee?

taxOutsourcing is without doubt a great way to grow your business and work more efficiently using expertise not necessarily available within your business. However, as is the way, you do need to be careful about the implications of outsourcing when it come to HMRC. You might think the person is a subcontractor, but HMRC might look at them as an employee and therefore expect you to pay their tax and National Insurance. Or if you are a limited company working for someone it could be you that becomes liable in the eyes of the taxman.

Why does HMRC even care? Money of course. They get more income from employer/employee situations due to National Insurance payments.

Getting Your Record Keeping Right

You cannot underestimate the negative effects of poor record keeping on your business including  paying excess tax, something that could potentially spell disaster for your business. At a minimum you have a legal requirement for everyone who pays tax to keep the records they need to fill in a tax return, for VAT registered businesses there are more specific requirements.

Simply put, though, it can be a challenge and frustrating at times, but it just makes good business sense to keep well organised and accurate records. If you can get this right in the early stages by setting up a system and sticking to it you'll find the process is a lot simpler to keep up-to-date.

Who Can You Trust These Days?

TaxVinceSo Vince Cable, the Business Secretary no less, has been fined £500 for not registering for VAT on his freelance income which, according to The Sun, was between £127,000 - £192,000 in 2009 -2010. So, the man known for campaigning against tax evasion has himself now been found to have evaded tax, although Mr Cable's aides have said it was not done intentionally and was reported by his personal accountants as soon as it was found.

When asked by The Sun, Mr Cable’s accountants’ Myrus Smith said, “When it became clear that Mr Cable's earnings had breached the level at which VAT was payable, an offer to settle immediately and in full was made to HMRC and this was duly accepted.”

Are You Keeping Track of Your Business's Expenses?

You might think it's not all that important to have a good understanding of how much money is being paid out each month in expenses, but this knowledge actually allows businesses to keep their taxes in good order, identify trends and, where needed, put new policies in place.

A study by opinionmatters.co.uk has found that around 20% of small businesses don't know how much they are paying out in expenses, with 40% saying that only their accountant knows the monthly expenses costs. Relying on an accountant only isn't an ideal situation as they don't have as full an understanding of your business as you and it's important for business owners to see what the outgoings in their business are. How else can an efficient business be operated?

Online VAT Returns Could Become Compulsory

HMRC is considering proposals that will make online submission of VAT returns compulsory for all start-ups, something that is presently only a requirement for those businesses with a turnover of more than £100,000. If agreed, the changes could be applied as early as April 2012.

However, there is strong opposition from the Forum of Private Business, which released a report highlighting the problems with the present online tax system. They have no problem with using the online system - so long as it's fit for purpose.

Hands Up If You've Heard Of RTI?

So, hands up for RTI then, anyone? Anyone? No? Well that's understandable. According to a recent survey by Sage UK you're one of a majority of those who haven't heard; the research revealed that three quarters of small UK businesses have no idea what it is.

 

What is RTI then? It stands for Real-Time Information and is HMRC's new brainchild set to improve the Pay As You Earn (PAYE) system.

 

According to the HMRC website, the introduction of the new Real-Time Information system will mean: “Employers will send HMRC information about tax and other deductions from employees pay when, or before, they make the salary or wage payment to the employee, rather than sending returns at the end of the year.”

Possible Tax Savings for Sole Traders

While many sole traders may think they are saving money by carrying out their own bookkeeping, research carried out by Unbiased.co.uk has shown over half might actually be missing out on tax savings because they are not using professional accountants for their bookkeeping. Of those surveyed, just over half admitted to doing their own accounts and a fifth of micro-businesses (which consist of 1-9 employees) were also taking a DIY approach to bookkeeping. Clearly it is a risky route to take, especially with the HMRC crackdown on poor small business accounting, which could land business owners with a hefty fine.

HMRC Sets its Sights on Small Businesses Not Paying VAT

Small businesses are being targeted again with the news that HMRC is contacting over 40,000 sole traders and one man companies who they believe should be paying VAT, which is presently set at a threshold of £73,000.

 

Businesses need to ensure they are fully aware of the financial situation of their company or risk facing fines up to 100%. At present businesses that aren’t VAT registered, but should be, are being offered a partial amnesty with reduced penalties on the outstanding VAT until 30th September, 2011. However, the HMRC has reserved the right to hand out fines up to 100% where it believes a business knew it should have been registered but didn’t come forward. How the HMRC will decide whether they believe a business knew they should have been VAT registered is not clear.
